Terms & Conditions
Last updated: 16 September 2026
These terms apply when you buy an original painting or order a commission from Daryl Lakey Art. Please read them before ordering. Nothing here affects your legal rights as a consumer.
1. Who we are
Daryl Lakey Art is a sole trader business run by Daryl Lakey, c/o 12 Scholars Place, Sparken Hill Gardens, Worksop, Nottinghamshire, S80 1EQ. You can contact us at any time at hello@daryllakeyart.com.
2. The paintings
- Every painting is an original, hand-painted work. Once one is sold it cannot be repeated, though a similar piece can be commissioned.
- Photographs show each painting as accurately as we can manage, but colours vary between screens, and brushwork and texture always look different in person.
- Sizes are given both framed and unframed where available, and are approximate. Where a painting is sold framed, the frame shown is not the frame you will receive but is a image generated to show what the picture would look like framed.
3. Placing an order
- Select the painting you want and click Buy Now. You will be taken to Stripe's secure payment pages.
- Check the details and complete your payment.
- We will email you to confirm. A contract between us is formed only when we send you that confirmation.
Very occasionally we may not be able to accept an order, for example if a painting sells elsewhere at the same time or has been listed at the wrong price. If that happens we will tell you promptly and refund anything you have paid in full.
4. Prices and payment
- Prices are in pounds sterling.
- We are not registered for VAT, so no VAT is charged.
- Delivery costs are shown before you pay. See Delivery & Returns.
- Payments are handled by Stripe. We never see or store your card details.
- The painting remains our property until we have received payment in full. Responsibility for it passes to you when it is delivered.
5. Delivery, cancelling and returns
Delivery times and costs, your 14-day right to cancel, and what to do if something arrives damaged are all set out on our Delivery & Returns page, which forms part of these terms.
6. Commissions
A commission is a painting created to your specification. The following applies in addition to the terms above:
- We will agree the subject, size, medium, price and rough timescale with you in writing (email is fine) before starting.
- A deposit of 50% of the agreed price is payable before work begins, with the balance due on completion and before delivery.
- We will share progress photographs at agreed stages in writing so you can comment as the work develops.
- Because a commission is made to your specification, the 14-day right to cancel does not apply to it once work has begun.
- If you cancel a commission after work has begun, the deposit covers materials and time already spent and is not refundable.
- Painting is not an exact science. Small variations from any reference photograph are part of the artwork, not a fault.
7. Copyright
When you buy a painting you own the physical artwork. Daryl Lakey keeps the copyright in the image, including the right to photograph the work and to reproduce it, for example in prints or promotional material.
You may not reproduce, copy or sell copies of the artwork without written permission. You are of course free to sell or give away the painting itself.
Images and text on this website belong to Daryl Lakey and may not be used elsewhere without permission.
8. Faulty or misdescribed work
Under the Consumer Rights Act 2015 the painting you receive must be as described, of satisfactory quality and fit for purpose. If it is not, you are entitled to a refund, repair or replacement depending on the circumstances. See Delivery & Returns for how to tell us.
9. Our responsibility to you
- We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care.
- We do not exclude our liability where the law does not allow it, including liability for death or personal injury caused by our negligence, or for fraud.
- Except where the law says otherwise, our liability to you will not exceed the price you paid for the painting.
- We only supply to private customers. We are not liable for business losses such as lost profit or lost opportunity.
10. Events outside our control
If something beyond our reasonable control, such as severe weather, courier failure or illness, delays your order, we will contact you as soon as we can and agree a new timescale. If the delay is substantial you may cancel and receive a full refund.
11. Complaints
If something has gone wrong, please email hello@daryllakeyart.com. We aim to reply within 1 working day and to put things right quickly.
12. Law
These terms are governed by the law of England and Wales, and disputes may be dealt with by the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own country.
